These Terms relate to use of the Website only. They do not constitute a costs agreement, engagement letter or retainer for legal services.

3. No solicitor-client relationship

We will only act for you once we have agreed to accept your matter and any required engagement documentation, costs disclosure, identification, conflict checks and other onboarding requirements have been completed.
We reserve the right to decline to act in any matter.
You should not assume that we act for you until we have expressly confirmed our engagement.
4. Confidential and sensitive information
You should exercise care when sending confidential, sensitive or time-critical information through the Website or by unsolicited email.
The submission of information to us before we have agreed to act for you does not necessarily create a solicitor-client relationship.
If your matter is urgent or subject to a limitation period, court deadline, settlement deadline or other time-sensitive requirement, you should contact us directly and obtain confirmation that we have agreed to act.
5. Legal services and costs
Where Assure Lawyers agrees to provide legal services, those services will be governed by the applicable engagement letter, costs disclosure, costs agreement and any other terms provided to you in connection with your matter, together with applicable professional and legal obligations.
These Website Terms do not replace or vary those documents.
If there is any inconsistency between these Website Terms and the terms governing our engagement to provide legal services, the terms of the relevant engagement documentation will prevail in relation to those legal services.
Legal fees, disbursements, trust money, billing and payment arrangements will be dealt with in accordance with your engagement documentation and applicable law.
6. No guarantee of outcomes
Any descriptions of our experience, previous matters, services, case studies or outcomes are provided for general information only.
The outcome of any legal matter depends on its particular facts and circumstances.
We do not guarantee that any particular result or outcome will be achieved.
7. Consumer rights
Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded, restricted or modified, including any rights that may apply under the Australian Consumer Law.
Where a law implies a right, guarantee or obligation that cannot lawfully be excluded, these Terms are to be interpreted subject to that law.
8. Payments and refunds
Payments relating to legal services are governed by the terms of the applicable engagement documentation, costs agreement and relevant legal and professional requirements.
Any entitlement to a refund will depend on the circumstances, including the nature of the payment, the work undertaken, amounts properly payable for legal services and disbursements, applicable trust accounting requirements and any rights available under law.
Nothing in these Terms limits any refund or other remedy to which you are entitled under applicable law.
9. Electronic communications
If you communicate with us electronically, you acknowledge that electronic communications may involve risks including delay, interception, corruption, unauthorised access, viruses or transmission errors.
We take reasonable precautions to protect our systems and communications but cannot guarantee that electronic communications will always be secure or error-free.
Where a law requires a particular form of communication, execution, delivery or notice, the requirements of that law will apply despite this clause.
10. Cybersecurity and payment fraud
Cybercrime and payment redirection fraud present risks to legal transactions.
You should carefully verify any request concerning the payment or transfer of money, particularly where an email or message claims that bank account details or payment instructions have changed.
You should independently confirm payment instructions with Assure Lawyers using trusted contact details before transferring significant funds.
If you receive a communication that appears suspicious or inconsistent with previous instructions, please contact us before taking any action.
11. Privacy
We collect, use, hold and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.

19. Governing law

The remaining provisions will continue to apply.

They do not constitute the entire agreement between Assure Lawyers and a client in relation to legal services and do not replace any engagement letter, costs agreement, costs disclosure or other document governing our professional engagement.
